it seems like a cool Idea for a weapon, giving it new ablities rather than building on old ones makes the old ones meh. 3rd level spell slot for 3d8 at 30ft isn't spectacular. its a legendary item so when you get to those levels balancing is a little harder because it depends so much on the campaign , run with it and see how it goes.
